But in truth you’re half right. While this doesn’t clear Trump at all it does put the attorney on the hook too. Not even attorneys are allowed to lie to the FBI. Trump can turn 1 into 2 like magic.

Not surprisingly, all of your flat footed statements need to be proven at trial. Triump's declarations supersede any previous labeling on documents.

If Trump's attorney relied upon Trump's statements that all of the documents had been declassified upon his either verbal or written directive then there is no lying involved on the part of the attorney regardless of whether he did or did not.

In any case, Garland raided the place put the country's attention on him. Now he has to deliver. Let's see it. I wonder if he will do a physical arrest of trump or a just issue a subpoena? He has to deliver on this or it mega-feeds into the political theater to harm Trump view.

Under federal law, Trump does not have the power to unilaterally declassify documents. There is a review process for this -- where the original classifying authority has to declassify the documents at the direction of the president -- for declassification to occur. The president cannot merely wave his hand over a document and claim "now this is declassified". There is a process that involves written documentation and several other steps.

It's not the case that a president can declassify documents with just verbal instructions. His instruction to declassify a given document would first be memorialized in a written memo, usually drafted by White House counsel, which he would then sign.

Typically, the leadership of the agency or agencies with equities in the document would be consulted and given an opportunity to provide their views on the declassification decision. As the ultimate declassification authority, however, the president can decide to override any objections they raise.

Once a final decision is made, and the relevant agency receives the president's signed memo, the physical document in question would be marked — the old classification level would be crossed out — and the document would then be stamped, "Declassified on X date" by the agency in question.

Former Trump administration officials have claimed that Trump previously declassified the documents taken with him to Mar-a-Lago, but that the classification markings had not been updated.

Excuse me but the attorney’s statement does not clear Trump like @Mercor speculated it does, nor is the attorney cleared because Trump may have told him or may claim Trump told him he declassified the 15 boxes of top secret documents in my basement.

I work with lawyers all of the time. When we are hammering out contracts and drafting official responses we both know whatever we represent has to accurate. You can’t just Willy nilly this stuff.

I can't read back right now in regard to Mercor statements etc.

I said this must be determined at trial. Trump's position and the attorneys are vastly different.

In regard to the attorney, if she made a good faith representation to the FBI that there were no classified documents in their based on her clients representations that he declassified them and she did not knowingly have information to the contrary, then you gonna have trouble prosecuting her. Believe me.

But nevermind anyway. Garland has signed up for the full process now, or is going to look like a witchhunter, which he is. And you are still in the "salivating over trump and everyone else around him gonna be convicted" stage. Okay, let's see it.
