Crude Oil - Cup & Handle? And USO.. wtf?

I have 2 questions.... looking at a one year chart of Crude Oil.. do we have a Cup and Handle breakout here?

Secondly, why with crude taking out 06 highs, is the USO not even close to it's 06 highs?
