The problem with this statement, which reads like something inserted at the last minute to placate someone, is that it makes no sense. Comey exonerated Hillary, not DOJ prosecutors. Either he did it on his own volition, which was clearly outside his authority, or he was instructed to do it, which raises bigger questions of political interference and obstruction.
The other problem with this statement is that it flies in the face of past DOJ practice in which innocent or careless actions were severely prosecuted. The most recent example was the sailor who snapped a few pics of his nuke sub to show his family. There was no espionage or anything else but he was treated like a hostile spy and sent to prison. Gen. Petraeus carelessly or stupidly gave his GF classified doc's. He also was prosecuted and the fact he was given a slap on the wrist is outrageous, given the treatment the sailor received. Still he was prosecuted.
The only consistency here seems to be the higher you are up the ladder, the less likely you are to be held accountable. That is the real scandal here, but no one can get past the politics to focus on it.

Comey was insubordinate to Lynch in that he concealed his intentions and acted independently of the chain of command without the knowledge or approval of his superiors.
In other words, just as I said. He acted independently and without authority.
No one, anywhere, whether the IG or anyone else in their right frigging mind believes that Comey was in the chain of command or authorized to step forward to independently and unilaterally exonerate Hillary. He is the top cop for christsake- not even in the prosecutorial division of DOJ. Even if Lynch needed to recuse, it would the decision would then fall to Sally Yates or possibly Rod Rosenstein. No one anywhere or any organization chart or theory anywhere allows Comey to usurp that role.
