Pence has control of the gavel but without majorities of both houses voting to nullify a state's electors, he has no real power. ---There is a situation in a contingent election where he could cast a vote for himself to break a tie. As far as the martial law scenario that you brought up, yes I am aware of it and it's not entirely out of the question. This thing is that important and if used, the fraud evidence would finally be heard in military courts.
