Sounds more like enemy to me. "National security impact" can be an issue well short of enemy status.

Hmm... maybe. Shit, you think Trump thinks that far ahead? Maybe he's using the tariffs as a wedge to get the Chinese to curb Kim... intriguing.

It all depends on how a trade agreement was implemented in the first place. NAFTA was implemented by law so Congress would have to approve a full withdrawal from it, contrary to Trumps statement that he can automatically just pull the plug. At the same time, I think NAFTA gives the president the power to call for a renegotiation so it gives him the power to frig with it and it get everyone in a tizzy. And of course if your party is in power that gives it more likelihood of being controlled by the president- except Trump does not necessarily have support from his own party- although some of the ones who disagree with him are even more adamant about the issue he is trying to get at.

That's why I said to Nine-Ender you are probably okay if you have something fair and reasonable to say for yourself when everything gets looked at but you better be prepared, because the president definitely has the power to drive a renegotiation and a re-look.

Some people have said that Trump can just kill NAFTA....and that he has the power to do it because that is what he did with TPP. Except TPP was just being proposed by executive order from Obama and was never approved by Congress so he did not need to have Congress unwind. it.

Then there are trade agreements that are part of full scale treaties rather than just an enabling statute. And if the treaty was approved by the Senate that makes it harder to just nix it although the President remains responsible for seeing that the other country is not frigging with us, so he has bitching and interference rights.

And then there are a pile of trade agreements around the world which don't rise a high level and the president is just left to implement them as part of his conduct of foreign affairs.

And then there are places like China and Iran and Russia where the tug of war sets in. The Constitution gives the power to regulate foreign commerce to Congress. Except it also makes the President responsible for maintaining the safety and security of the country. So he might not have the power to put a tariff on China without Congressional approval if he states his purpose as just not letting china stick it to us economically.....but he probably has the power to put tariffs and less-favored status and related sanctions on to China for supporting North Korea.

It's complicated and depends on how he makes his case. It's like the emergency immigrant ban thing from dangerous countries. He probably clearly had the power to do that on a temporary basis but he fucked up and started presenting it as a muslim ban which is not an allowable argument.

Same with sanctions. He can put sanction on countries based on some powers he has, and so can Congress based on some powers it has, and mix and match. Same for removal. And as I said you have to look to how everything was implemented in the first place. Obama got cute and entered the country into the "Iran Deal" when it clearly was full blown, far reaching treaty. Except he did not want to deal with the Senate on it. So he got cute even though it was very big treaty/deal. But the flip side of it is that because he never got senate approval he probably can just cancel the whole thing by executive order.

I hoping that NAFTA will get renegotiated in a way that Canada will end out paying for the wall with Mexico. :cool:
