CCW holder arrested for leaving his gun locked up safely at home

Quote from Tsing Tao:

This is pretty much how it is here in Florida. I was stopped by an officer on a routine traffic stop. The officer told me he noted that I had a CCW, and asked me if I had the weapon on me. I replied "It wouldn't do much good to have the CCW if I didn't." He smiled and just said "yeah, figured I'd ask. Is it loaded?" I just gave him a silly look and he smiled sheepishly.

Ended up letting me go with no issue.

I was told the complete opposite here in FL by several officers. I'd love to know what's really able to be pulled up by an officer on patrol, however, if you've been told this on a traffic stop.

Just open carry and problem solved

Now that's actually illegal in Florida, for whatever reason. A ccw holder here was arrested not long ago for having the bottom of his holster showing. Did it stick? Of course not, but he WAS sadly put in handcuffs, and jail over it.

The trooper was probably FutureCurrent's brother....

There was another post on Slash Dot (and here on P&R, I believe) last year about problems in Maryland for gun owners...

Since Maryland is heavily Democrat, you can believe it's originating at the top levels of the state - Governor, AG, head of State Police, etc. Kinda ironic since the state capital is blocks away from the US Naval Academy...

ANY state that's labeled as "democrat" is a communist state worthy of either leaving it, or re-taking it.

Long story short, use turn signal before lane change in TX

God bless TX; I am sure TX trooper could have given me a ticket if he wanted to:cool:

Reminds me of a video I saw a year or so ago of a FL man with a CCW permit being tackled to the ground by two or more officers. His offense? His holster was sticking out just below his shirt. Technically illegal, yes. But wouldn't a simple warning have sufficed?

That applies anywhere...

The key nowadays is that LEO are focused on revenue generation, and out-of-state drivers are sitting ducks since most will not come back to fight the ticket....

Of course, if you have anything that would be considered abnormal or suspicious, stopping/searching/seizing/jailing would be a bonus..

Local governments love civil forfeiture laws... They can take your stuff (and car) based upon the flimsiest of probable cause.

Out-of-state - drive the speed limit, use your turn signals, drive sober and alert, and you should be fine... Still, some plates (like CA anywhere in the South along I-10) will get pulled over and cited no matter what.

We've got somewhat relaxed gun laws here, but carrying exposed being a crime isn't one. What an ignorant law for FL. Where I lived before, a person needed zero permits to carry exposed. Of course, I wouldn't do that for any reason, but there shouldn't be a law against it.

A Michigan citizen who committed no crime was harassed at gunpoint by Grand Rapids police officers, and now he’s filed a Federal lawsuit against the officers, the police chief, and the city for unlawful detainment.

from MLive:

Deffert’s attorney, Steven Dulan, who is also spokesman for Michigan Coalition of Responsible Gun Owners, said Deffert’s constitutional rights were violated when he was unlawfully stopped by police.

The city earlier released a recording of a woman’s call to 911 about a man with a gun. The dispatcher told the caller that it was legal to openly carry a handgun, but dispatched police to investigate a “suspicious person” with a holstered firearm.

As Moe held Deffert, Deffert repeatedly said he was not a felon and he could legally open carry. State police say open carry of firearms is not illegal as long as the firearm is carried with lawful intent and not concealed.

“It’s illegal for you to stop me for it in the state of Michigan,” Deffert is heard saying in the recording.

Later, he said he was just walking home after having breakfast at New Beginnings restaurant.

“I’m not breaking a law. … I’m just walking.”

The officer responded: “You’re talking to yourself. You’re going down the road here with a loaded handgun.Could I just think, maybe, you might be some kind of a nut?”

A little later, an officer said: “Is that what you do on a Sunday, you want to stroll down the road? “

Deffert said: “It’s not against the law.”

Shortly before Deffert was released, he officer said, “Well, you’ve got everybody fired up around here today.”...
