California AG Threatens to Sue if Trump Administration Places Citizenship Question on Census

California Attorney General Xavier Becerra is threatening to sue if the Trump administration includes a question regarding citizenship on the 2020 census.
The San Diego Union-Tribune reports that Becerra worries citizenship questions will dissuade some California residents from taking the census, thereby under-representing themselves and running the risk of a loss of federal funding for certain parts of the state.

Becerra is part of a coalition of 19 attorneys general who fighting against inclusion of a citizenship. They sent a letter to U.S. Commerce Secretary Wilbur Ross on Monday, in which Becerra described counting everyone, citizen or not, as a “sacred responsibility.” He wrote:

What the Trump Administration is requesting is not just alarming, it is illegal. The Constitution requires that, every 10 years, we accurately count every person in our country, regardless of citizenship status. This is a sacred responsibility. It determines how many Congressional seats each state receives and how billions of dollars in federal funds are distributed. At the local level, it should also produce an accurate population count that our communities can rely on to identify the need for critical services such as disaster relief, infrastructure, public health, and police and fire protection.

Becarra continued:

The California Department of Justice is putting President Trump on notice: if a citizenship question is added to the 2020 U.S. Census Bureau questionnaire, we are prepared to take any and all necessary legal action to protect a full and accurate Census. This is clearly an attempt to bully and discourage our immigrant communities from participating in the 2020 Census count. We also call on Congress to fully and immediately fund preparations for the 2020 Census. California simply has too much to lose for us to allow the Trump Administration to botch this important decennial obligation.

California Secretary of State Alex Padilla added, “We will not sit idly by while this administration undermines yet another pillar of our democracy.”

This the garbage you get when your borders have been open for decades with no requirements for assimilation.
 
How can you have an accurate allocation of voters and therefore a proper allocation of representatives in the House of Representatives if you count millions of non citizens in the population of the state?

You have to have the right to vote to be counted in the census...
So ask a second question.... do you have a right to vote in an American election.
If you answered yes...
are you...
a. a citizen
b. not a citizen but believe you should vote because the CA A.G. thinks you its your right.

But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the executive and judicial officers of a state, or the members of the legislature thereof, is denied to any of the male inhabitants of such state, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such state.

Agree, this shit should have been handled years ago in fact I remember it was on the ballot in the 90’s in California.

House electoral votes are reallocated based upon population... not by registered voters. California will eventually have a bigger say in the government just because they get allocated more house seats. Illegals count the same as anyone else.
 
I realize that we get taught that all the time...

but... my point is that the fourteenth amendment shows it should be based on voters not population. I don't think the CA AG is properly considering the US Constitution. It's not the amount of people it is the amount of voting citizens per the 14th amendment. (unless there is another clause in the constitution which says otherwise.

by operation of logic... this would work females denied the right to as well.

You’re wrong. The apportionment is based on the whole number of persons in each state. The California AG is correct. The 19th amendment enfranchised women into the 14th and 15th amendments.

Increases in population leads to increases in house seats. And the electoral college representation for each state is based on the sum of senators and house reps for a state. So.......for those of us who are not democrats and still accept the fact that the electoral college elects presidents-rather than the popular vote- you are indirectly giving voting power to illegals by allowing non-resident population numbers to be used in creating additional house seats.

the argument is whether everyone should be counted or citizens.

so it does not matter how it was done but how it should be done according to the constitution.

The authority would be ranked like this....

1. The constitution and its amendments
2. The Supreme Ct...
3. Perhaps treaties
the...
4. if the above does not speak... then we could consider other sources.

Since the Constitution has spoken we have this as the law and what the sup ct might say...
so my argument per the 14th amend is... male voters... then per the 26th amendment citizens.

“Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons. The Number of Representatives shall not exceed one for every thirty Thousand, but each State shall have at Least one Representative…”

You are wrong, too. Apportionment is based on whole number of persons in each state. Citizenship is NOT a factor in representation according to the constitution.

The apportionment calculation is based upon the total resident population (citizens and non-citizens) of the 50 states. In the 2010 Census, the apportionment population also includes U.S. Armed Forces personnel and federal civilian employees stationed outside the United States (and their dependents living with them) that can be allocated, based on administrative records, back to a home state. This is the same procedure used in 2000.
