There are other dimensions to this scenario.

FIRST.

Putin is an obsessive observer and interferer in American politics. The United States and Russia are currently at odds- even before the invasion- and the U.S. loses no chance to paint Putin in the worst light (well deserved) and Russia loses no chance to try to diminish the perception of American presidential power vis a vis Russian presidential power- ie. Putin. As a student of American politics and presidential power he knows that Biden owes his presidency to the support of progressives- with blacks and gays or those who support their issues being right at the top and the core of Biden's support. So for Russia to seize and hold a high visibility black and lezbo and then to tell Americans there is nothing they can do about it- essentially- basically castrates Biden and causes his base to turn on him. Putin lives for that and it is indeed happening.

SECOND. Not to forget because Putin never forgets, he does things for domestic consumption as well. Putin and Russia are vehemently anti-gay, anti-trans, anti all that stuff. Putin and Russian State TV beat the drum everyday saying that one of the reasons he needs to take Ukraine is because Ukraine is western decadence right on its border and that gay marriage, drag queens and all of that are coming soon if the western values that Ukraine does or will embrace are not snuffed out. So a lesbian coming through customs with her "wife" begging for mercy is not going to lead to local Russians screaming for her release- even if they could legally. They are high fiving Vlad for cracking down on those creeping western values and snuffing them out.

Putin is milking this thing by jacking the sentence up. And then at some point down the road, whether in a month or five years he will release her early for some deal or public showing and milk it all over again on her way out.

Trump would have just said "Vlad lets work this out. The CIA has a list a mile long of Russian operatives working in the U.S. that we can either just continue to watch or arrest tomorrow creating a dilemma for you as well. So, Vlad, you think this over and get back to me before the end of next week with how we can prevent this crisis from getting in the way of our beautiful relationship. I mean, you still want this to be beautiful, right Vlad? Because I can go the other way too if you want."

The US was stupid. When Brittney Griner was arrested, the US should have done the same with the Russian Nikita Mazepin. Just using the same tactics as Russia does (fake proces with fake justice). Put him in jail for 15 years and then propose a deal Griner against Mazepin.
Griner would already have been home.
