the Hard way was to put him down which he was. The overboard way is to keep choking him even though there were 5 knees on his back pinning him to theground. I agree with you. Cop tells you get down you get down period, but cmon meng.
 
There is no doubt about it hed still be alive if he complied but it still doesnt give the cop the right to start choking him.

I think he stopped choking him when they had him prone.
The medical report said his windpipe wasn't damaged.
 
^ It doesn't matter if intent was there. A drunk driver that runs over someone doesn't intend to do that. He still goes to jail. Pre- existing medical conditions don't matter. The guy just didn't drop on his own. He was choked, taken down hard, and then heavily leaned on by several police officers. There actions are directly correlated to the mans death. They don't take him down in this fashion, he's still alive today can be easily argued.
If a Grand Jury can be manipulated to "indict a ham sandwich" if the prosecutor wants it is a system that is broken. If a Grand Jury can be convinced that there is no reason at all for further investigation where there is clearly just cause for further investigation, that is a system that is broken.
On the subject of whether this is a racially motivated incident? I don't know if it was or not, or if it was just a bunch of pumped up cops who clearly were abusing their authority, a bunch of guys who have no business with a gun and a badge, it doesn't really matter. Their actions were abusive, excessive and directly caused this mans death. At a minimum these cops need to be put on trial, further investigations needed, cross examination to be done. If a jury finds them innocent, so be it, but to conclude this case warrants no trial at all in flat out nuts.

Actually, "intent" plays a great deal into sentencing and crimes. That's why premeditated murder gets much more time than manslaughter.
