According to multiple news outlets, a Staten Island Grand Jury declined to indict an NYPD officer for the choking death of Eric Garner, the second high-profile Grand Jury decision not indict a police officer in the death of an unarmed black subject in the past two weeks:



The 43-year-old Garner was stopped by NYPD officers in July for allegedly selling untaxed cigarettes. In amateur video, officer Daniel Pantaleo is seen placing Garner in a choke hold, as the suspect yelled “I can’t breathe.” The city medical examiner declared Garner’s death a homicide, and the NYPD disciplined three officers following the incident.

The NYPD is on high alert for conflicts with protesters. After the Grand Jury in Ferguson declined to indict officer Darren Wilson, Ferguson saw days of unrest.

Seriously though, I don't think so. NYC cops have to keep a tight lid on the place with that many people and that much money. Homies will get themselves "kilt or even worse". Be interesting if we see the usual looting and arson in other places though.
 
The verdict is correct. Of course liberals will use their straw man argument by claiming that he was killed for selling cigarettes when in truth, he was resisting arrest and the cops had to use force to subdue him. The killing wasn't intentional but if Garner would have simply taken his charge instead of fighting, he'd be alive today.
 
There is a common thread to all these cases, uncooperative suspects.
This needs to be taught in schools.
  1. Don't make your legal case to the cop, save it for the court
  2. Keep your hands in view
  3. Ask before you move your hands anywhere.
  4. It can be indignant to be questioned by authority, deal with it
  5. You may have a racist cop, even more reason to act proper.
  6. If cop asks you to get on the ground , don't raise your hands in the air. Most times cops don't want your hands overhead, it can be threatening.
NYC and Ferguson would have had better outcomes if these rules were followed.
 
So many things wrong here. This is all the police have to do is bust people for selling loose smokes? This petty crime warrants this type of escalation? Cops over did this one, in a big way. Grand Jury must have something other than the video, because the video is really damning evidence that the cops took this way too far.
Was the guy a career criminal? 31 arrests I'd say yes. Should he have dialed it back? Yes. Was he resisting to the point that this take down had to occur in the fashion that it was? Absolutely not! Was he swinging on anyone? No. Was he doing anything other than pissing and moaning about being confronted by the police? No. There was no imminent threat to the police. None at all! There is more than enough doubt cast by the video that a indictment should have been brought. Reckless endangerment at a minimum.
Can't screw the pooch to this degree and expect blacks not to have an argument about police abusing their authority. Major fuck up.
 
I'm with the Captain. I don't know enough about this to speak with anything other than speculation, but something smells fishy.
 
Timothy Loehmann, Cop Who Shot Tamir Rice, Deemed Unfit For Policing 2 Years Ago



The Cleveland police officer who fatally shot a 12-year-old holding a replica gun in November was deemed unsuited for police service two years ago, newly released documents show.

Timothy Loehmann, now 26, was employed by the City of Independence Police Department in Independence, Ohio, for six months in 2012, the Guardian reports. In an internal memo from that November, Independence Deputy Chief Jim Polak criticized Loehmann’s behavior during a firearms training.

"He could not follow simple directions, could not communicate clear thoughts nor recollections, and his handgun performance was dismal," the memo, available in full at Cleveland.com, states.

According to the report, Loehmann became “distracted and weepy,” in part because of an issue with a girlfriend and uncertainty about his future. Polak criticized Loehmann for being “not mature enough in his accepting of responsibility or his understanding in the severity of his loss of control on the range,” and concluded the report with recommending that Loehmann be “released” from his position.

The memo also cites several previous issues, including Loehmann removing a bulletproof vest at the wrong time because he felt too warm.

"I do not believe time, nor training, will be able to change or correct the deficiencies,” Polak wrote.

Loehmann quit the force days after Polak’s memo was sent out, citing “personal reasons.” His personnel file classified him as “eligible for rehire,” WOIO reports.

He was hired by the City of Cleveland in March 2014. It’s unclear whether or not Cleveland officials ever saw the memo before he was hired.

Surveillance video of Loehmann fatally shooting 12-year-old Tamir Rice was released last month. Loehmann was responding to a 911 call about someone pointing a gun at people at a Cleveland park. Rice was actually just carrying an airsoft gun, which shoots non-lethal plastic pellets.

The caller said the gun was “probably fake,” but police say the dispatcher did not relay that detail to them, according to the Washington Post.

In the video, Loehmann can be seen firing at Rice within two seconds of pulling up in his cruiser. The 12-year-old died of his injuries the next day.

Loehmann, as well as his patrol partner, 46-year-old Frank Garmback, are on paid administrative leave pending a decision on whether to pursue criminal charges.

I don't know squat about this case, but the GJ did vote to not indict. One presumes they know more than us.
