Tapes would be evidence on either side. Saying FBI agents who lie are guilty of a crime doesn't mean anything. Anyone who lies under oath is guilty of perjury. It means that if Trump can provide evidence that Comey lied then Comey goes to jail. He doesn't even have to take an oath, if the memos are proven lies then that's it for Comey.
