They extracted prosecutorial information from him the first time around in return for the plea deal that has been invalidated. It is reported that provided information to facilitate the prosecution of Lehman Bros. types. So do those who were convicted or discovered with the aid of his information now get to argue the "fruit of a poisonous tree" principle?
It's messy stuff. I probably will generate some hate mail- but from a civil liberties point of view- I would imagine that Epstein has some valid legal defenses- at least worth trying. How the hell is this supposed to work? The government enters into a plea deal with someone and gets useful information- and then comes back and says- "oh we fucked up and did not follow the law but thanks for the info that we used to prosecute others and now we are going to prosecute you."
Very dicey stuff there. If I enter into a plea deal with prosecutors and they fuck up on their end, that's their fucking problem - then they just botched a prosecution. The victims may have rights that the government violated and are probably entitled to compensation from the government. Very dicey way for the government to proceed that way. Offering plea deals, getting the bennies from it, and then still coming after you.
More information could change my view. Just sayin, I am not immediately lining up to cheer for how the government handled it the first time or this time around either. Again, not denying- and am in favor of- large civil settlements for the victims, where proven.
