Legally, the testing is a slam dunk but without a law passed by Congress I don’t know how much an actual vaccine mandate will hold up in court. The key here is vaccination being an alternative to the testing. At least in my mind. If the Biden team pushes the brute force approach through a federal rule, they very well could lose.

Ok, the government doesn’t need agreement to impose a rule. However, I am not familiar with federal rule making procedures and what can be suspended etc. Yes, I too would be be pissed if I faced fines for unvaccinated employees. What I will say is that the Biden team is not the Trump team. They are going to be ready for all of this and I expect they worked out these legal kinks.

Also, it’s the unsaid thing that most and I do mean most employers are secretly glad for this. They don’t want Covid in their businesses, they work their too. If make over $100k you’re vaccination rate is the highest in America. Plus it brings stability to your business.

Private businesses being able to remove unvaccinated employees is not the federal government’s doing. The feds are saying tests but will accept vaccination in lieu, or pay a fine. How you handle unvaccinated employees is your business. Courts have already told unvaccinated workers they can go kick rocks if they get fired. That’s all.

If federal govt is fining you $14,000 for each un vaxxed employee it is naive to say the government is not forcing you to fire that employee. it is like saying you dont have to fire that employee but if you dont I am going to beat the shit out of you repeatedly.... so if you decide to fire them... dont blame me haha

I am not sure an employer would be secretly glad having to pay fines to the government. As I said in another post Wal mart is not requiring all employees to be vaccinated nor is CVS. If they wanted them all to be vaccinated they would have required it. Now they are going to have pay millions for those employees.... took teh choice out of their hands. rather than punish the individuals who wont get vaxxed you are hammering private corporations in a way....

The employer can also require the employee to get jabbed.

IMO, that's the goal: to get employers to require vaccinations, not terminations.

This outbreak is costing the government a ton of money. That $14,000 is probably not punitive, and is likely too low.

I doubt there will be very many fines. For most of the larger employers this what they’ve been waiting for. They don’t want anti vax problems but this will give them the cover they need and want for a mandate - really a condition of employment. Like I said the weekly testing seems to me like the lawful route to get to the mandate because employers don’t want to collect test samples and process the results and report them weekly. They want a vaccination card and to be done with all of this.

What we are not talking about is how popular this is. This is as much of a political move as it is a health and safety measure. It’s not a coincidence this comes after Afghanistan and right before the deal making on Biden’s “human infrastructure” plan. This is all connected.

I liked the first half of this post because I agree with you the testing and the fines is to get to the end goal of it’s just easier to have vaccinated employees. The fines won’t nearly make up for the money spent on Covid. But the sooner we get fully vaccinated the better our economic prospects will be and that is an advantage.

Everyone is not going to agree on everything.

If the majority (MSM) believe that what a company (Enron) or person (Karen) is doing is reprehensible, then that's what the majority believe.

If Karen's sister wants to do what Karen did, but is discouraged because of the backlash Karen got, then so be it.

Some people will only do the right thing because of fear of prison/shame. That's a feature, not a bug.

President Joe Biden on Friday told opponents of his administration's Covid vaccine mandates to "have at it" with legal challenges, lamenting that the issue has grown so politicized.

"I am so disappointed that particularly some Republican governors have been so cavalier with the health of these kids, so cavalier with the health of their communities," he said.

On Thursday, Biden announced a series of vaccine mandates that will affect over 100 million Americans: all federal employees and contractors, workers at companies with over 100 employees, federal workers who are employed at a health care provider receiving Medicare or Medicaid funding, and employees at schools receiving Head Start funding, among others.


Republican governors have already announced their intent to challenge these mandates, including Brian Kemp of Georgia and Kristi Noem of South Dakota. Florida Gov. Ron DeSantis, whose state has lifted virtually all pandemic mitigation measures, said in a press conference that he opposes "mandates of any kind."

In remarks Thursday at a school in Washington, Biden vented his frustration with governors who have been unwilling to more aggressively compel their states' residents to get vaccinated. Biden added that there's "not a scientist in this field" who would say that his proposals, including the vaccine requirements, aren't common sense.

"If these governors won’t help us beat the pandemic, I’ll use my power as president to get them out of the way," he said in his Thursday address.
