The broader rule will work because the testing is lawful. Remember when the aca was defended in court as a mandate under the tax code - that was a mandate by coercion. This broader testing rule is the same legal principle. You’ll see.

An emergency order that can deny private citizens property without due process? Kind of like DeSantis wanting to fine cruise ships for defying his executive order right?

I dont think the EA by the DOL is the precedent we want or passes the due process test.... also right now the proposed EA is so vague so that os another ding against it.
