Conservative author and commentator Candace Owens was denied medical care in the form of a coronavirus test by a Colorado laboratory because of her political beliefs

Owens was sent a letter by Aspen Laboratories' co-founder Suzanna Lee informing her that her "booking" was being cancelled and that she would be "denied service" because of both her aversion to governmental face mask mandates and her analysis of the effectiveness of vaccination shots.

"We cannot support anyone who has pro-actively worked to make this pandemic worse by spreading misinformation, politicizing, and discouraging the wearing of masks and actively dissuading people from receiving life-saving vaccinations," Lee wrote in the letter

You are aware that medical faculties and doctors in the U.S. can deny you treatment if you fail to conform to their medical guidance. For example -- if you go to the doctor who prescribed medicine for your ailments and you refuse to take the medicine & follow their guidance then the doctor can cancel your next appointment and tell you to find medical treatment elsewhere. Likewise if you show up at a medical facility stating upfront you won't follow their guidance then they can cancel your appointment. All perfectly legal.

The only situation where this does not apply is emergency room treatment at a hospital where they cannot turn you away from treatment -- but they can tell you are not hurt/sick enough to require their care after evaluation.

Testing laboratories that collect "lab samples" are licensed medical facilities. Whether you go there for Covid tests, employment screening drug tests, or to have your blood tested for A1C levels --- all fit under the medical umbrella.

I do agree that this particular example was driven by the harmful anti-public health politics practiced by Candace Owens -- which implied Candence would not follow the medical guidance gleamed as a result of the Covid test such as wearing a mask -- which clearly made the lab believe they would be wasting their time & resources by accepting her for an appointment. The lab is on solid legal ground in doing this.

Wrong. Regardless of your opinions regarding Candace Owens, a “test” has no ulterior motive or political stance. It’s informational for a health care practitioner or the individual.

Haven’t we been told testing is a good thing? Why wouldn’t you want to test someone, they could be positive and asymptomatic... this could prevent spread.

No, the testing facility has an axe to grid and just wanted to make life difficult for Ms. Owens.

Any medical facility --- that is not a hospital emergency room -- can deny any patient services if the patient refuses to follow their guidance. In this case, Candace Owens made it clear up front she would not follow their guidance. Candace Owens has no legal recourse -- all she can do is gripe about it on social media.

What guidance? A testing facility can not offer medical advice. They test, period.
