No. You are missing the point.

If the colleges allege that a wide range of factors is/are the determining factor but if an applicant of a different race - e.g. black- with the same factors would be accepted but one of a different race- e.g. Asian- is not then the decision is arrived at based on a person's race.

This is contrary to the U.S. Constitution.

Not going to try the case here. But I am missing exactly Zero of the relevant points.

He got rejected but blames AA....because he was told by the school?

What most of you skip over is SAT/GPA is not the only factor nor is it mandatory. What if he got in and someone with a 1590 and 4.7GPA didnt...should he then be booted? Doesnt work that way.

The admissions counselors see how reality works every day and many are advising their advisees accordingly based on reality.

If you are black with near perfect test scores you have a good shot at a top school.

If you are Asian and have near perfect test scores and the school has reached its quota for Asians you are not good to go.

This is what the lefties call "the lived experience of minorities." versus all the white guy arguments about it. The Asians are sharing their "lived experience" but I guess that does not work for them.

Given the amount of applicants to Harvard who apply with high SATs and high GPAs is greater than the actual spots available, numerous applicants with high SATs and high GPAs are rejected. Period.

Also.....uh.....high SATs and high GPAs are not the only criteria...this has been true for years. Someone with high numbers and nothing else are not as attractive to high end institutions because they are not trying to admit robots with nothing more to offer.

Take the Asian guys test scores and attach them to a fictious applicant named Lateisha Shavonne Latoya and she is good to go.
 
You are missing the point. It does not matter if someone with better or worse numbers get in.... the numbers are not the determining factor so he cannot prove he should have gotten in because he has no right to entrance simply because his SAT was 1580. If all the coleges say the entire application matters then his argument that a 1580 means he demands to be accepted is not valid.

Constitution does not say you must get into Harvard, just says Harvard and colleges cannot discriminate against an entire group and prevent them from attending.

Harvard or MIT is not mandated to accept only students with high SATs so how can he claim that he was rejected when other qualified applicants were also rejected. How can he claim Harvard is discriminating against Asians when Asians are represented at a rate 4x higher than their population representation?

Just because FOX news told you he was rejected and he claimed it was because he was Asian is not a fact, it is media intepretation. The valedictorian at my son's HS is Chinese and got a high SAT score and really high GPA taking AP and Honors classes and......got accepted into Harvard! She also started a cancer non-profit that opened up chapters in various high schools and was active in school leadership positions and numerous volunteer organziations. It is not just about the numbers.
This may be an overly naive question... but why don't they just take the "Race" question off the application? Like a blind placebo study in an FDA trial.

Before we can truly become a nation with no cultural animosities, it would seem to me that this stuff must be relinquished to the annals of history.

No you hypothesized that plenty times but what we can say for a fact based on the averages is that Asians with lower test scores did get in to Harvard which proves that it is not just about test scores, it is about the essay, recommendations, volunteer work, types of classes taken, leadership opportunities, work experience, internships etc...

Dems have a problem with Asians and Jews and increasingly with Muslims. It manifests in many ways. The skids are greased for blacks because they are the core of the Dem Plantation. The others, not so much.

It can be about all those things. Just make the total application consideration void of race.
If a kid has perfect sat's but zero extracurricular stuff... well they lose out to someone that had maybe not so perfect scores, but came close, and ran the local YMCA summer camp.
