Democrats are well aware americans detest their open borders policy. Their strategy therefore is to rule it out of bounds for discussion, unless they are using it to pander to minorities. Congressional republicans are only too happy to accommodate, since they are so far out of step with their base on the issue.

The democrats now actually have as a core value that any discrimination between legal and illegal immigrants is unconstitutional and brands one also as an obvious Nazi. Even raising immigration makes you a Nazi.

If you look at the senate bill from 2013, there is plenty of money for border security and e verify and a number of other things.

Under the equal protection clause the right to due process applies to anyone on us land. So I don’t know what you mean by that.

Otherwise any distinction made in law would be unconstitutional, clearly an absurd result even for something as poorly drafted as the 14th Amendment. Immigration status is not a protected category like race and therefore legal distinctions or policies only need meet a very low standard of rationality.

Discrimination is a legal term and, yes, under the constitution while due process is afforded to foreigners on US lands, the justice system can certainly, and should, discriminate based on residency status. I don’t know why you are posing this as something democrats oppose. I’m sure there are some advocacy groups and fringe types that argue differently but by and large this is understood. If you look at Obama’s deportation record, his administration deported at record numbers totally within this framework.
