Ann Coulter's Delta Twitter Rant Shows She Is a Hypocrite Who Wants Liberal Consumer Protections

By Matthew Cooper On 7/17/17 at 12:10 PM

Ann Coulter’s tweetstorm about Delta Air Lines illustrates the conservative author’s social media reach and power, her acid tongue and an element of hypocrisy—since she implicitly seems to believe that Delta should be forbidden from overbooking or being able to move passengers, even while often railing against the type of government regulation that would be necessary for such restrictions.

If you were actually enjoying your summer Sunday, you might have missed that Coulter, who is six feet tall, was livid when Delta bumped her out of one of those pay-extra-for-more-legroom seats, replacing her with what the bestselling author called a “dachsund-legged woman.”

She ripped into Delta Air Lines, which tweeted back that her comments were “unacceptable.”

The irony here is that the arch-conservative Coulter finds herself on the same side as liberal consumer advocates, who have been arguing that passengers need more rights.

“An airline can give up your spot, no matter if you have a spot booked or not. They can remove you using an air marshal [for instance] if the plane is too heavy to fly due to atmospheric conditions—and really for any reason they come up with,” George Hobica of Airline Watchdog told BravoTV this spring after a passenger was removed by air marshals for refusing to give up the seat he'd paid for. “‘Transportation is not guaranteed’ is a common proviso in the airlines’ contracts of carriage,” Hobica said.

If Coulter wants her seat guaranteed, she should take sides with liberals and argue for more regulation, not less; and for a stronger consumer-rights lobby, not rules that are written largely by the industry for the industry. Don’t expect to see her making those arguments anytime soon.

There’s an old adage that “a conservative is a liberal who’s been mugged,” and thus cares about crime, and a rejoinder that “a liberal is a conservative who’s been arrested,” and thus cares about civil liberties. If she were more intellectually honest, Ann Coulter might become a Ralph Naderite before this is over.

what a bizarre argument. Newsweek is almost as ridiculous as Washington post in their bias: if it were a leftie complaining about this they would be wetting their pants in excited support.

Usually when an airline is criticized in public they are quick to apologize, but in this case they fought back :D

Delta Stands Up To Ann Coulter, Becomes A Hero On Social Media

Airline fires back after conservative commentator’s Twitter tirade.

Delta Air Lines is drawing rave reviews on social media for something it did while on the ground.

The airline took to Twitter on Sunday to defend itself after being bashed by Ann Coulter for allegedly giving her “carefully chosen” seat to another passenger.

Along with attacking the airline, the conservative commentator also posted pictures of the passenger she said got her seat.

Delta replied:

While airlines are usually on the wrong end of the ire of social media, Delta’s reply drew plenty of praise, such as this tweet:

Delta answered:

Coulter, however wasn’t very happy with the reply. She wrote:

CNBC reported that Coulter had initially booked a window seat, which she changed to an aisle seat within 24 hours of departure. The network said Delta moved her back to a window seat in the same row to accommodate other passengers and after “some confusion over seating assignments.”

Coulter then took to social media to attack the airline, its workers, its union and even the wifi.

The airline’s response to the tirade drew plenty of praise:

I fly nearly every week.

With this story involving Ann Coulter I am on the side of Delta for the most part. Ann Coulter went completely overboard in this situation; taking pictures of the person in "her" seat, endless idiotic tweets, etc. etc.

The terms of service for an airline says they can move your seat assignment for any reason. If you are placed in a lower class then you may get a refund. However airlines regularly need to trade seating assignments for a number of reasons; to distribute weight on smaller planes, to place families together, to arrange exit row seating, etc. etc.

I can support a little bit that the airline should provide a proper reason why you were booted from your selected seat and some minor compensation possibly. But Ann went completely overboard in this situation.

But Ann went completely overboard in this situation.

She pre-booked the extra legroom seat and paid extra for it. She might have taken a different flight or another airline had it not been available. Then she was rudely moved out of it for no reason. Delta still has not come up with a reason. It is increasingly looking like she was targeted.

BEWARE OF @DELTA REPUBLICANS. Texts from a flight attendant: It was political. @Delta still won't give a reason.pic.twitter.com/Tcxp2DlPa0

If this had happened to an African-American liberal instead of an American like Ann Coulter, the left would be having a never ending conniption fit.

contracts of adhesion are unlikely to fly....

you don't have to be a leftist to think Ms. Coulter has an argument.
you just have understand the law of contracts.

companies can not just do whatever the heck they please because they include overbearing terms in their one way contract.

Ms. Coulter has a strong argument for stating she purchased a seat with certain amenities and the company agreed to provide that seat in exchange for valid consideration. When Delta did not provide that seat they breached their contract. The question is do they have a valid excuse.?

Arguing they have some clause in their take or leave contract which may state they can abrogate their duties willy nilly is not going to fly... in many courts in many states. (pun intended)

This article by Cooper did provide a reason that might stand.... if the payload is too heavy for the conditions and Delta changed seats in a logical and fair manner, courts might not challenge deltas safety concerns

However, the second clause the expert used is very dubious...

"Transportation is not guaranteed’ is a common proviso in the airlines’ contracts of carriage,” Hobica said."

That sounds like the airlines have created...

https://en.wikipedia.org/wiki/Standard_form_contract
.
A standard form contract (sometimes referred to as a contract of adhesion, a leonine contract, or a take-it-or-leave-it contract) is a contract between two parties, where the terms and conditions of the contract are set by one of the parties, and the other party has little or no ability to negotiate more favorable terms and is thus placed in a "take it or leave it" position.

While these types of contracts are not illegal per se, there exists a very real possibility for unconscionability. In addition, in the event of an ambiguity, such ambiguity will be resolved contra proferentem against the party drafting the contract language.
