Universal background checks aren't mandatory in Texas as Texas republicans wont make it mandatory and nationwide they aren't mandatory because republicans in Congress wont make it mandatory so it would probably be very hard to convict the seller.From my experience with private and gun show sales its a don't ask don't tell type of thing between the buyer and seller.

Universal background checks might not be mandatory, but you still cannot sell a firearm to another individual if they don't meet certain criteria. Additionally, if the sellers were made public, you could open them up to civil litigation, which would then deter future similar sales if people know they could be sued for it.

What certain criteria?

Ive been to gun shows in Texas with friends who have bought guns.Every time it was don't ask don't tell between buyer and seller.

Here is the problem. We have thousands of gun control laws already on the books but, none of them are being seriously, enforced at all. Those for more and more gun control laws, add more laws that are practically useless when, there is no enforcement. Take the case of criminals not allowed to have any guns. How many criminals get caught with a gun but, are not even charged for it? Extreme liberal DAs of late are in the news, simply dismissing hundreds of cases the whole US and not even bothering charging violent criminals for murder or rape, instead releasing them back out without filing any serious criminal charges nor even spending a long time in jail? This has been happening for a while now.

Federal gun laws like felon in possession of a firearm and illegal possession of a fully automatic weapon are certainly enforced.Less than 10 % of people arrested for illegal possession of a gun are felons and last I looked it up only 3 people have been killed with a fully automatic weapon since 1987.

Guns laws need to be handled on the federal not state level but republicans in congress wont allow it.
