I'm no lawyer, but if Surf didn't open the file, I'm not really sure if Prof has much of a case against him.
Let's play this in reverse. One of Prof's "students" sends him an email about how bad a trader Surf is. He includes an old ebook that Surf used to sell. Prof posts about it on ET but doesn't open the file. You think he'd be worried about Surf taking him to court? What should he do? Report his own student to the authorities immediately for sharing proprietary material?

They should both start a real simulator account, and compete to see who goes broke last with no refills allowed. I will fade all their trades with real money and make some change on the side.

I suggested that, too. Trade against each other for 1 year. No posting on each other's threads or bickering on other threads allowed. Let the best guru/system win...or at least not go bust.

Actually, I have posted real time before the fact trades since 2002.
We are still waiting for any evidence of Prof's secret sauce by way of a journal and series of real time calls without charts showing woulda coulda shoulda.
