Yeah, time to wake up. What's wrong is a criminally corrupt congress that has three god damn decades to actually do something about this immigration problem and they haven't done a fucking thing. The left had no problem with this inaction but suddenly it's a top priority. Hmmmm,wonder why. And of course, now in panic mode, the solution being offered is just let everyone in carte blanche.

If an alien is determined to be a "visa overstay" under this section, he/she is subject to the following penalties:

Cancellation of visa

The law provides that the visa of individuals who overstay is automatically voided and all future nonimmigrant visas must be obtained in the country of nationality, except for those who are eligible for an exemption due to "extraordinary circumstances." If the individual has more than one visa in the passport, only the visa that was used to enter the country is considered to be void, but when the other visa expires, a new visa application must be made in the home country (DOS cable, June 1999). It is important to remember that I.N.A. § 222(g) can only be used to deny a visa if the applicant is a third-country national applying in a country other than the home country. If an individual who is subject to I.N.A. § 222(g) applies for a visa at a U.S. consular office in his or her home country, § 222(g) is not a basis for denial of the visa.

Restriction on place of future visa applications

If subject to INA § 222(g), the alien is permanently limited to applying for future nonimmigrant visas only at a U.S. consular office located in the country of his or her nationality, unless the Department of State finds that "extraordinary circumstances" exist.

You've now switched the discussion to a legal alien overstaying their visa. This isn't what I posted about. We were discussing illegal entry into the United States.

I made absolutely ZERO comments on overstaying a visa. Everything I posted was about crossing the border illegally, and your comparison to jaywalking.

Furthermore, the discussion on illegal immigration is almost entirely about people crossing the border illegally. Very few people actually care about visa overstays - except maybe in a broader discussion on immigration reform.

Just because you find the facts not to your liking doesn't mean you can take the conversation in a completely different direction.

Except we don't take the children of jay walkers or first time pot offenders, which is what the law says overstaying a visa or crossing illegally is equivalent to. Which is why there were programs such as catch and release which the orange turd decided to scrap. There simply was no money for GEO or core civic if they could not lock up the brown people, and this administration had to answer to their donors.

Everything I said - everything I posted about - all of my legal comments and discussion were about illegal entry and your comparison to jaywalking. Not one comment I made - anywhere - was about visa overstays.

And you know it.

Besides, in your comment you quoted you explicitly say "crossing illegally is equivalent to jaywalking" which is patently false.

Visa overstays, which are also illegals, are being treated the same way in this zero tolerance policy. And no, I clearly don't agree that their kids should be taken away or be incarcerated for long periods of time, for the same reason first time pot smokers aren't given a year in jail, even if it's in the books.

This was also the policy of previous administrations, before fox and their Ilk decided terrorists were no longer the biggest threat to America, but rather the browning of America was.

You have to understand there is now a profit motive in keeping illegals locked up, rather than being expedient with their deportations (past admins).
