The standard legal definition of hate speech is any speech that degrades a "protected group". Racial Minorities, Gays, etc. are protected groups, white males are not.

This means under hate speech laws any comment about a protected group deemed derogatory will be prosecuted, but you can say anything you want about white males.

We see the same sort of issues in the prosecution of "hate crimes" today.

And besides, your argument is circular, because existing laws were put there by human beings in government. So they were "move the goal posts" when they were being put in place.

That the Constitution can be amended is apriori acceptance that laws evolve. But it is certainly possible to de-evolve it as well.

It would be circular if there were goal posts to move. IE, if there were boundaries on what you could say. But there aren't, so it's not circular. And don't try to say "you can't say you will kill someone"...that's not speech that is being prosecuted, it's intent.
