2nd Amendment... "Right to bear arms shall not be infringed"...

What would he be "criminally charged" with?

He used too many bullets?
He shot the guy "execution" style? Is that a thing?
People that are shot don't die instantly in all cases. What if the guy had rolled over and fired a fatal shot at the good guy?

Edit: the shooter obviously had no idea the gun wasn't real.
