I've never heard that it's illegal, not sure why it would be. It's always a good idea in case one brokerage is having technical problems and you're in a position that you would like to get out of. You can always just short it in the other account.

I don't believe you have a bear futures contract like FAZ to FAS. If you just want pure correlation then do then next expiration out, or have two brokerage accounts and go long ES is one and sell the ES in the other. What are you doing with FAS and FAZ?
