    I filed many forms and never gotten anything back. It is not worth it as it is way too easy to get denied, and the lawyers get all your info and the money from the settlement. I was the op for the other thread by the way

    Thank you, but is it average holding period of 31 days from what I read? Because I can lower my average with my 200 daytrades a day that I currently do on penny stocks while holding the other blue chip stocks longterm

    I have significant wash sale losses from stocks I daytraded. I want to invest in these stocks for over a year since I think they are cheap. Can mark to market be active if I do both: invest for over a year in certain stocks while daytrading other stocks in the same account?

    7 out of 12 months have passed. My hot start has slowed down. If I extrapolate the data to a full year, I am on target to make 200k, and pay 50k in commissions and sec fees. Is the brokerage 25% cut too much in terms of being a successful trader? Daily, I have 60% losing trades with 40% winners...

    Thank you so much! The federal tax penalty is prorated though right? Like if I owe 25k but paid 9k so far, I would only pay 6% interest on 16k and not the full 25k?
