It is a 5 month sentence.... assuming an appeal can take longer than 5 months it would be "cruel and unusual punishment" for him to stay in prison waiting for an appeal for longer than what his actual prison sentence is. Obviously his appeal will fail miserably but he still has a right to file...

people get out on bond all the time for non violent offenses with longer prison sentences... not sure this is priviledge but rather how bond/bail works.
