T+3, settlement date to be absolutely sure. On ECN fills, they have a time limit for the counterparty to file a bust request (say 1 hour).

Actually yes, I think they will sit by. If they go after Cramer for saying this stuff, then they would have to pursue close to all hedge funds for securities violations. Odds are that won't happen.

Most of his statements he says "If I were them and I were desperate, I would do this..." or "At my hedge fund I would have done this..." Pretty sure he can't go to jail for saying stuff with qualifiers like that. I detest Cramer though.

The thing that people are implicitly saying here is that naked shorting is without risk. I.e., let's just create more shares to sell and knock the price down further. The only way it is risk free is if the company is properly valued at $0.

I am talking about a situation where a stock is artificially inflated for long periods of time. Just like naked shorting screws over the longs, the stock that defies all intuition for rational valuation screws over the SHORTS.

Since it is illegal, it should be abolished. In its current form it is probably used to either deviously manipulate the price of a stock downwards or it is a response to the fact that so many people want to bet against a company because of its lack of quality, that they have to naked short...

Unfortunately, Cramerites would just do the frenzy in pre-market the next morning. It would actually affect the market least if the show were on during market hours. At least then there would be enough volume to counterract the hyper overreactions.
