    It is extremely overbought and its earning is close so it will be volatile and good chance to cover if you short at these levels. One of the reasons that CAT is up recently was short covering because of bad shorting ( big size and small stop gap).

    After reading all your posts, my advice would be to find a broker that suits your needs and are happy with or at least are less unhappy with. No matter you are right or wrong, your feeling is very important and trading is very hectic and you should not add the frustration with your broker to it.

    Also when shorting, check the short interest rate. I remember once SHAK interest rate was 140% !!!. That mans if you had shorted at $40 and covered the next year at $40, you had lost $$56 per share !!!!

    I believe that rule is for accounts less than 25K. If you have a larger account, that rule does not apply and once you covered, the cash is tradable. There is no difference between going long or short.

    My account says it is not available for short "NOW" but things are dynamic and and it can change any time. I used to sell naked in the money calls for shares that were not available and then when the option was assigned, I was atutomatically short and they would let me keep the position :)
