    zoo - when you charge someone a fee based on whether or not you are profitable, that very easily could fall under the CFTC umbrealla. That was my point. In addition, trying to bill like this and manage the admin (behind the scenes) could be rather difficult.

    I would suggest looking at the YM or ES for something a little less rough and jumpy. The ER2 is the most volatile in my opinion and very easy for stops to be taken out. It may just be the market you are trading in. Have you traded in the ES and/or YM?

    Not too often. Sometimes a trailing stop will be taken out and then I reenter shortly there after.

    Pabst - not a scalper, mainly intra-day. Willing to hold for as long as the signal stays valid. Basically, try to capture the larger moves and probably shaken out of the choppy movements.
