The % win rate use alone has no significance. You can have a strategy with a 97% win rate and still losing money. You can have a strategy with a 30% win rate and making tons of money. [Win rate] + [R:R] is what you should be looking for.

In Canada, when you day-trade and/or actively trade, your gain/loss is not considered as a capital gain/loss. It's considered as a regular income. Taxes are different. Capital gain is only 50% taxable (up to a max).

I don't know anything about US tax laws, but to me, wash sale doesn't apply to day-trading. But I'm not an expert, so I might be completely wrong.
