    From what im reading my assumption would be if there's any doubt you should claim active trader status. If wash sales become an issue you'll have that from a legal standpoint.

    Yeah the article doesn't have all the information. A 30 day window is required to buy something back after it's been sold to prevent a wash sale. If it's been sold permanently for more than 30 days then the wash sale(s) aren't enforced. The IRS doesn't have the manpower go through every single...

    How would the 1256 contracts help him? There's no wash sale on only those contracts. Unless im wrong here. Im assuming he was only trading stocks.
