It looks to be between 9:40-9:50, the bar poskes above the BB, and the next bar makes a lower low, but also a higher high - so I suppose that invalidates a possible entry? Thanks!

Is that a hypothetical example? I have never heard of the IRS going after someone because of failure to observe the "wash sale" rule. Fact is, a great majority of traders do not follow that rule. Call it gambling, but again I have never heard of one case of the IRS going after someone...

What type of stop do you use? I went through the past twenty days worth of data, and saw some good trades that followed your methodology, but also many that failed. I would be interested to know your money management/stop/exit strategy. Thanks for sharing.

I usually don't have a problem, though sometimes early weekend morning it will be down for a few hours...but not very often. I seem to remember getting an email from TNT about RT being down for a substantial time this weekend due to server maintenance...I looked for it but already deleted it...
