Yes, 15 is the number for accounts under management, what if the advisor is ouside the states and the clients too ? Indeed , more complex than you think, one should consult an attorney..

Brownsfan019, Charging a fee based on being profitable or not , falls that under the CFTC or not ? a "could" answer is very unusefull

Oanda's game performance will match Oanda's real account performance very,very close.

At least, paper trading will show you if you have an edge. Real trading will show to what extent emotions effect that edge. So, paper trading HAS it's value. Don't go live before papertrading confirms that your techniques work or trade so small that emotions...
