    My understanding is the cap means the first 60 percent gets the special tax treatment. Amounts over that are just not eligible. It’s not a disqualifier for the whole amount.

    Ok, so, if I qualify, my Sec. 1256 taxation drops from a blended rate of 60%/40% to 0%/40%, about 15%? That's friggin' awesome? What administration do I thank? Can I go back and amend to 2008?
