If adding commissions kills it, it likely means the average amount per winning trade is so small that it can't account for covering commissions, let alone any negative slippage. I thought tradestation could resolve to tick level, but without as much history available as minute intervals....

You can share it with a big brokerage since they do it all the time. Then if you get caught, have them pay your part of the fine and, MOST IMPORTANTLY, ADMIT NO WRONGDOING. This leaves you free to make up for the fine in the next one when you don't get caught! :D
