So basically, if I do not have professional trading status with the IRS regarding the retail account those losses can not be used against the K-1 income even if they are ordinary losses.

Right around 8pm Oracle traded up .77 on 2 lots of 259K shares. Is this someone who just wanted to get in at all costs before the open? Or is this some type of possible trading error? Just wanted to hear some thoughts.
