The comment period was up June 19th, but it appears the SEC is still accepting posts.
Seems like now the market has rallied a little they have completely dropped the ball on this.

Exactly...The majority of stocks barely trade in the pre/post market and have wide spreads that do not represent accurate pricing - therefore having an index that was calculated based on these prices would be inacurate and worthless.

Where I come from, inefficient pricing = opportunity for traders.
Either way - Reg NMS still exists, which means that if a print is going to occur on one of these dark pools, the pool still has to ensure that there is not a better price available...

From what I can gather there is an ECN called Chi-X (owned by instinet) that has been operating for about a year in some of the major markets and is starting to gain some decent market share (~10%). There are also a few other due to begin trading before year end (Turquoise / BATS).
Yes it is illlegal - it is called front-running.
Hedge funds have investors, if a trader at a hedge fund front runs the funds orders in order to profit for his own account it is illegal.
